Privacy Policy
This Privacy Policy explains how Spikit ("we", "us", "our") collects, uses, and protects your information when you visit spikit.dev, join our waitlist, or use the Spikit desktop application (collectively, the "Service"). Spikit is built and operated by Nacho Poletti, based in Argentina.
1. Information we collect
Waitlist: When you join the waitlist, we collect your email address and your preferred language. We use this to send you launch updates and product news.
Voice and transcription (desktop app): When you use Spikit, your audio is sent to OpenAI's Whisper API for transcription and returned to your device. We do not store your audio or transcriptions on our servers.
Account and billing: If you subscribe to a paid plan, billing is handled by our Merchant of Record, Lemon Squeezy, which processes payments and manages billing and applicable taxes on our behalf. We never store full card numbers.
Usage analytics: We may collect anonymous usage data (feature usage, performance metrics) to improve the product. No audio content is included.
Crash reports and diagnostics (opt-in): If you opt in from Settings, the app sends anonymous crash reports and performance diagnostics to Sentry, our error-monitoring provider. This data helps us fix bugs and improve performance. It never includes your audio, your transcriptions, or the content of any window or document you are working with. You can opt out at any time in Settings.
2. How we use your information
- To provide, operate, and improve the Service.
- To send transactional emails (waitlist confirmation, account notifications, billing).
- To send occasional product updates. You can unsubscribe anytime.
- To detect, prevent, and respond to security incidents or fraud.
- To comply with legal obligations.
3. Third-party services
We rely on the following processors to operate Spikit:
- OpenAI (Whisper API): audio transcription. Audio is sent for transcription and not retained by us; OpenAI's data handling is governed by OpenAI's privacy policy.
- Lemon Squeezy (Merchant of Record): payment processing, billing, tax handling, and subscription management.
- Supabase: backend database (account data, entitlements, waitlist) and authentication.
- Resend: transactional and product email delivery.
- Sentry: anonymous crash reporting and diagnostics (only active if you opt in from the app).
- Lovable: hosting of the spikit.dev marketing site and legal pages.
Each provider processes data under their own privacy terms.
4. International data transfers
Spikit is operated from Argentina. Some of the processors listed above (OpenAI, Lemon Squeezy, Resend, Sentry, Lovable, Supabase) store and process data outside Argentina, primarily in the United States and the European Union. By using Spikit, you consent to these international transfers. We choose providers that offer appropriate safeguards (such as Standard Contractual Clauses) where applicable.
5. Data retention
- Waitlist: we retain your email until you ask us to remove it (write to hello@spikit.dev) or until our launch communications are complete, whichever comes first.
- Account data: retained while your account is active. After you close your account, we delete personal data within 90 days, except for billing records (invoices, transactions), which we retain for 10 years as required by Argentine tax regulations.
- Crash reports (if opted in): retained by Sentry for up to 90 days, then anonymized or deleted.
- Audio and transcriptions: never stored on our servers.
6. Your rights
You can request access, correction, or deletion of your personal data at any time. To exercise these rights, email hello@spikit.dev.
7. Security
We use industry-standard measures to protect your data, including encryption in transit (HTTPS/TLS). No system is 100% secure; if you believe your account has been compromised, contact us immediately.
8. Children
Spikit is not directed to children under 13 (or the equivalent minimum age in your jurisdiction). We do not knowingly collect data from children.
9. Changes to this policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email or via the Service. Continued use after changes means you accept the updated policy.
